Terms of Service

These Terms of Service govern your engagement with Twelve Bar Digital, a web design and digital services business operated as a sole trader in South Australia, Australia. ABN: 85 519 485 402.
By engaging Twelve Bar Digital for any service, you agree to the following terms.
1. Services
Twelve Bar Digital provides website design, build, and ongoing support services for small businesses. Services are offered across three tiers as follows:
Tier 1 — Website build (one-off fee): Includes website design and build, domain setup assistance, content population, contact form, Google Maps embed, SEO basics configuration, and site launch. Delivered within five business days of receiving all required client content.
Tier 2 — Hosting only (monthly, no lock-in): Includes third-party platform hosting via Readdy (readdy.ai), SSL certificate, and site uptime monitoring. Does not include content updates, reporting, or support calls. The client's site remains live and accessible for the duration of active subscription.
Tier 3 — Monthly care (monthly, no lock-in): Includes everything in Tier 2 plus a set number of content updates per month (up to two hours of changes), a monthly website traffic and performance report, and access to phone or email support for site-related queries. Additional work beyond the included hours will be quoted separately.
Clients may move between Tier 2 and Tier 3 at any time with 30 days written notice. Downgrading from Tier 3 to Tier 2 takes effect at the start of the next billing cycle following the notice period.
2. Use of artificial intelligence
Twelve Bar Digital uses AI-assisted tools — including Readdy (readdy.ai), operated by Interactive Link Pte. Ltd — to design and build client websites. This allows us to deliver professional websites at an accessible price point within a fast turnaround. All AI-generated content is reviewed, customised, and approved before delivery. By engaging our services you acknowledge and accept that AI tools form part of our build and maintenance process.
3. Fees and payment
Current fees are as follows:
- Website build: $500 AUD, payable prior to or upon delivery of the completed website.
- Hosting only (Tier 2): monthly, no lock-in.
- Monthly care (Tier 3): $80 AUD per month.
All fees are in Australian dollars and are GST-exclusive. Twelve Bar Digital is not currently registered for GST. In the event of GST registration, clients will be notified and pricing updated accordingly.
Payments are processed via Stripe. Invoices are issued via Zoho Invoice. Monthly retainer payments are charged automatically on a recurring basis via the payment method provided at sign-up. It is the client's responsibility to ensure their payment details remain current. Failed payments may result in suspension of hosting services.
4. Cancellation and offboarding
Either party may cancel a monthly retainer (Tier 2 or Tier 3) with 30 days written notice to hello@twelvebardigital.com.au. Notice must be received in writing and a confirmation will be sent within two business days.
Upon cancellation of a monthly retainer, the client's website will remain live until the end of the current billing period. After this point the site will be taken offline unless the client arranges alternative hosting.
Upon request, Twelve Bar Digital will provide a code export of the client's website within 10 business days of cancellation, allowing the client to host their site independently or migrate to another provider. Domain names registered in the client's own name will remain fully under the client's control at all times.
Twelve Bar Digital reserves the right to terminate hosting services for any client with 30 days notice if continued hosting is no longer commercially viable, including but not limited to changes in third-party platform pricing or availability.
5. Domain ownership
We strongly recommend that clients register and maintain ownership of their own domain name through a registrar of their choice such as VentraIP or Crazy Domains. Twelve Bar Digital can assist with domain setup and DNS configuration but accepts no liability for domains registered on a client's behalf. Clients who wish to cancel services must ensure their domain DNS records are updated to point to their new hosting provider.
6. Hosting and third-party platforms
Client websites are hosted via Readdy (readdy.ai), operated by Interactive Link Pte. Ltd, Singapore. Twelve Bar Digital is not responsible for any interruption, modification, or termination of services caused by Readdy or any other third-party provider. Readdy's own Terms of Service apply to the underlying platform and can be viewed at readdy.ai/terms-of-service.
In the event that Readdy ceases to provide services, substantially changes its pricing, or becomes unsuitable as a hosting platform, Twelve Bar Digital will make reasonable efforts to migrate affected client sites to an alternative provider with a minimum of 30 days notice. Twelve Bar Digital accepts no liability for losses arising from third-party platform failure.
7. Content and intellectual property
You retain ownership of all content, images, logos, and materials you supply to Twelve Bar Digital. Upon full payment of the build fee, the design and content of your website is yours. Twelve Bar Digital retains no ongoing claim to your website content.
You warrant that all content you supply does not infringe the intellectual property rights of any third party. Any claims arising from client-supplied content are the sole responsibility of the client.
8. Revisions
The standard build fee includes up to two rounds of revisions prior to launch. Revisions requested after launch or beyond this scope will be quoted at an hourly rate or addressed under an active Tier 3 retainer where hours permit.
9. Limitation of liability
Twelve Bar Digital's total liability to you for any claim arising from our services is limited to the total fees paid by you in the preceding 30 days. We are not liable for any indirect, consequential, or incidental loss including but not limited to loss of revenue, loss of data, loss of business opportunity, or business interruption arising from website downtime, third-party platform changes, or any other cause.
10. Governing law
These terms are governed by the laws of South Australia, Australia. Any disputes will be subject to the jurisdiction of the courts of South Australia.
11. Changes to these terms
Twelve Bar Digital may update these Terms of Service from time to time. Clients on active monthly retainers will be notified of material changes by email with a minimum of 14 days notice. Continued use of services after that date constitutes acceptance of the updated terms.
